Privacy notice for FHV Library
We handle your personal data carefully and conscientiously. We comply with statutory data protection regulations at national and European level when processing data and are providing you with the following information in accordance with EU GDPR article 13.
Purpose of data processing, data categories:
The personal data you provide us with is used to carry out library administration and loans (borrowing authorizations, borrowing transactions, dunning and fee administration).
Students, employees and external lecturers of the Vorarlberg University of Applied Sciences receive a Campus Card, which also entitles them to use the library, on the basis of the existing contractual relationship.#
If external library users apply for a library card, such a card will be issued, which contains the name and the card number with bar code.
We expressly point out that, in accordance with the library regulations, the respective terms of use of the e-resource you are using must be observed. In addition, we recommend that you carefully read the privacy statements of the respective e-resource providers.
If you use the option to create user accounts, bibliographies, alerting services or otherwise enter personal or business data (e-mail address, names, addresses, etc.) within the e-resource offerings, you do so at your own risk.
The storage location can be seen from the respective data protection declarations of the e-resource providers. If this is outside the EU and there is no adequacy decision of the European Union, the corresponding state does not have an adequate level of data protection. This means that data security is at best not guaranteed and data subject rights may not be enforced.
An adequacy decision of the European Union with regard to data protection provisions currently exists only for Andorra, Argentina, Faroe Islands, Guernsey, Isle of Man, Israel, Jersey, Canada, New Zealand, Switzerland and Uruguay. Legal basis:
In principle, personal data is processed for all library users in order to fulfill a contract (Art. 6 para. 1 lit. b) DSGVO).
For students, employees and external lecturers of the FHV, there is thus a contractual obligation to provide personal data to the library of the FHV; there is no legal obligation to provide data.
There is neither a contractual nor any other legal obligation for external persons to provide the personal data. However, if the data is not provided, the borrowing of media from the FHVis not permitted. In principle, the library of the FHV can be visited independently of the provision of the data and media can be used there on site. However, the library regulations apply in any case.
Recipients:
We would like to inform you that your personal data will be processed in the library program to carry out the administration of loans. Data processing is carried out by the publisher Ex Libris in a cloud environment within the European Union.
Shibboleth can be used for authentication and authorization for web applications and web services, so that users only have to authenticate once at the Vorarlberg University of Applied Sciences in order to access content from different providers (cf. https://de.wikipedia.org/wiki/Shibboleth). More information on this can be found at https://www.shibboleth.net/legal-information/. Please note that personal data may also be transmitted to providers during authentication and authorization using Shibboleth.
Beyond this, personal data will not be disclosed to third parties unless this would be necessary for legal prosecution.
Retention period:
Data is stored for the purposes stated above and to safeguard the legitimate interests of FHVin order to ensure proper library operations.
Your personal data will be retained by us only for as long as reasonably deemed necessary by us to achieve the above purposes and as permitted by applicable law. In any case, we store your personal data as long as legal retention obligations exist or the statute of limitations for potential legal claims has not yet expired.
Your data protection rights according to GDPR:
Please be aware that you generally have rights to access, rectify and erase your personal data, to restrict its processing, to obtain it in a portable format, to withdraw your consent and to object to its processing. You may address enquiries and requests on this topic to datenschutz@fhv.at.
If we process your personal data based on your consent, you may withdraw your consent at any time by sending an email to datenschutz@fhv.at., If data processing is based on the legitimate interests of FHV, you may object to this processing and include your reasons for the objection, however the lawfulness of data processing activity conducted prior to withdrawal or objection shall remain unaffected. If you believe data processing to be unlawful, we ask that you contact us by emailing datenschutz@fhv.at. Moreover, you have the right to lodge a complaint with the supervisory authority, the Austrian Data Protection Authority.
