Data protection and information for the management of applicants' data

 

The protection of your data is important to us. We respect the legal provisions applicable to data protection in the EU and in Austria.


Purpose of the use of data, data categories:
Your data, which you disclose to us in the context of your application, is processed with the help of automated systems and used by the employees of the Human Resources Department of the FH Vorarlberg for the purposes of the application procedure. In addition, the persons responsible for recruiting for vacant positions at FH Vorarlberg have access.

The following data is collected and processed for the automated processing of your application:

• First name, last name, e-mail and, if applicable, also address/place, date of birth, title, telephone number, citizenship.
• Additional questions depending on the respective job advertisement (e.g. driving license)
• Curriculum vitae, in particular information on professional experience and training
• Skills (e.g. Photoshop, MS Office)
• Application photo
• Qualifications, awards and language skills
• Letter of motivation
• Additional files and documents that you may upload

The written, electronic communication that takes place between you and FH Vorarlberg GmbH is stored via the Prescreen application tool. Furthermore, Prescreen processes comments and evaluations that are posted about you in the course of your application process.


Legal basis:
Confidentiality interests worthy of protection are not violated in the use (this is any type of handling of data, i.e. both processing and transmitting) of non-sensitive data if this is necessary for the fulfillment of the contract or the data subject has consented to the use (Art. 6 para 1 lit. a) and b) EU-DSGVO). With regard to the fact that you are transmitting your data to us for a job application and, if applicable, an employment relationship is established, you are transmitting your data to us as part of a pre-contractual obligation.

In addition, due to the transmission to us, your consent to data processing exists. You can revoke this consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation. The provision of personal data is necessary for the conclusion of the contract. If you do not provide us with them or revoke your consent, no contract conclusion is possible.


Recipients:
FH Vorarlberg GmbH uses the e-recruiting system "Prescreen" under the domain *.jobbase.io, on which companies can post job advertisements as well as receive and manage applications, which is operated by Prescreen International GmbH, Mariahilfer Straße 17, 1060 Vienna (hereinafter "Prescreen"), to carry out application procedures for vacancies. In this context, Prescreen acts as an order processor iSd DSGVO for FH Vorarlberg GmbH. Prescreen's privacy policy is available at https://prescreen.io/en/privacy-policy-website/.

In the case of filling key positions, your personal data will be transferred to the respective appointment commission. The members of the commission are bound to secrecy and may not use your data for their own purposes. If your application was transmitted to the FH Vorarlberg via the Public Employment Service (AMS), we are also obliged to inform the AMS about the result of your application (acceptance/rejection). Beyond that, your data will not be transmitted to third parties.


Retention period:
Once an application procedure has been completed, the documents of the successful applicant are transferred to the personnel file. The documents of unsuccessful applicants are generally deleted or destroyed 7 months after the end of the application process, or kept for 12 months with the consent of the applicant. If documents are kept longer in order to be able to contact applicants at a later date for another advertisement, the consent of the applicant concerned will be obtained before the retention period is extended.


Your data protection rights according to GDPR:
Please be aware that you generally have rights to access, rectify and erase your personal data, to restrict its processing, to obtain it in a portable format, to withdraw your consent and to object to its processing. You may address enquiries and requests on this topic to datenschutz@fhv.at.

If we process your personal data based on your consent, you may withdraw your consent at any time by sending an email to datenschutz@fhv.at, If data processing is based on the legitimate interests of FH Vorarlberg, you may object to this processing and include your reasons for the objection, however the lawfulness of data processing activity conducted prior to withdrawal or objection shall remain unaffected. If you believe data processing to be unlawful, we ask that you contact us by emailing datenschutz@fhv.at. Moreover, you have the right to lodge a complaint with the supervisory authority, the Austrian Data Protection Authority.
